The Liquor Control Act (235 ILCS 5/6-5) permits self-distributing manufacturers, distributors, and importing distributors to extend credit to retail licensees for the purchase of wine or spirits products for up to 30 days. Self-distributing manufacturers, distributors, and importing distributors are required to submit to the Commission no later than Thursday of each calendar week, a verified written list of the names and addresses of each retail licensee who, on the first business day of that calendar week, was delinquent beyond the permissible 30 day-period. A delinquent retail licensee who has two or more retail liquor business locations shall be deemed to be delinquent with respect to each commonly owned business location of such retail licensee. Retail licensees who are reported as delinquent are prohibited from purchasing wine and spirits products from self-distributing manufacturers, distributors, and importing distributors until the delinquency has been cured. Similarly, self-distributing manufacturers, distributors, and importing distributors are prohibited from making sales to a retail licensee who has been reported as delinquent.

The Commission has developed a list format to permit the easy review of the reports of delinquency. The Delinquency List contains those retail licensees who have been reported as delinquent as well as those retail licensees who have common ownership with delinquent licensees. The Commission adds newly reported retail licensees to the Delinquency List on Thursday afternoon or the next day if the report is received after 3 p.m. (unless those days are State holidays).

The Liquor Control Act (235 ILCS 5/6-5) requires all self-distributing manufacturers, distributors, and importing distributors to submit to the Illinois Liquor Control Commission reports of all previously reported delinquent retail licensees who have cured such delinquencies. These reports are required to be submitted by the close of the second full business day following the day the delinquency was cured.

The Commission will remove retail licensees from the Delinquency List on the day it receives the cure report or the next day if the report is received after 3 p.m. (unless those days are State holidays).
